Strengthening Jinayat Law Enforcement Post Covid-19 Pandemic in Banda Aceh

This research aims to ascertain the dynamics of jinayat law enforcement and the strategies employed by the Banda Aceh's Government to reinforce the jinayat law. The strengthening of jinayat law enforcement in Banda Aceh has become a matter of concern in the context of a general decline in jinayat law enforcement in other regions and the appointment of acting regents/mayors who are more inclined to pursue national interests than regional ones. This research employs a qualitative methodology with a legal sociology approach. This research found that the dynamics in the enforcement of jinayat law are primarily regulated by the relevant legislation. Criticism of Qanun Jinayat Law has focused on a number of key areas, including human rights issues, the children and women protection, and discriminatory practices against non-Muslims. Furthermore, the strengthening of jinayat law enforcement in Banda Aceh has been influenced by pro-sharia political policies implemented by the Banda Aceh administration. The implementation of pro-sharia politics in Banda Aceh is evidenced by the establishment of effective coordination between law enforcement agencies, the provision of sufficient budgetary resources, and the implementation of comprehensive socialization programs. This strengthening is also corroborated by statistical data, which indicates a notable decline in the incidence of jinayat violations, with a 34.32% reduction observed in the period preceding the pandemic.
