Post-Publication Discussion
Post-Publication Discussion
1. Policy Statement
MAQASIDI: Jurnal Syariah dan Hukum recognizes that scholarly communication continues beyond the publication of an article. The journal encourages constructive, evidence-based, and respectful academic discussion to promote critical engagement, clarify legal and scholarly arguments, and maintain the accuracy and integrity of the published scholarly record.
Post-publication discussion provides an opportunity for researchers, academics, legal scholars, and other interested readers to examine published arguments, question interpretations, identify potential errors, and contribute alternative perspectives within the fields of Sharia and Islamic law.
This policy is implemented in accordance with the principles and recommendations of the Committee on Publication Ethics (COPE).
2. Scope of Discussion
Post-publication discussion may address, but is not limited to, the following matters:
-
Theoretical, conceptual, or methodological issues in published articles.
-
Interpretations of Islamic legal doctrines, fiqh, uṣūl al-fiqh, and maqāṣid al-sharīʿah.
-
Legal reasoning, statutory interpretation, judicial decisions, and the application of Islamic law in contemporary legal systems.
-
The use and interpretation of primary and secondary legal sources, including legislation, court judgments, classical Islamic legal texts, and scholarly literature.
-
Alternative interpretations, critical evaluations, or further implications of published findings.
-
Factual, bibliographical, methodological, or analytical errors requiring clarification.
-
Substantive concerns regarding research integrity or publication ethics.
3. Submission of Comments and Scholarly Critiques
Readers and researchers who wish to comment on a published article may submit a scholarly comment, critique, or letter to the editor to the journal's editorial office.
Submissions should identify the article under discussion by providing its title, author(s), publication details, and DOI or URL, where available. The submission should clearly explain the issue being addressed and provide relevant supporting evidence, references, legal authorities, or scholarly arguments.
All submissions must be original, academically relevant, and written in a professional and respectful manner. Personal attacks, discriminatory statements, defamatory allegations, and unsupported accusations will not be accepted as legitimate scholarly discussion.
The submission of a comment does not guarantee its publication. All submissions are subject to editorial assessment.
4. Editorial Assessment and Peer Review
The Editor-in-Chief or a designated editor will assess each submission for relevance, scholarly merit, clarity, evidentiary support, and compliance with publication ethics.
Where necessary, the editorial team may request additional information, consult independent subject experts, or subject the submission to peer review.
The editorial decision will be based on the academic contribution and quality of the submission rather than the author's institutional affiliation, professional status, or position on the issues discussed.
The journal reserves the right to decline submissions that lack sufficient scholarly substance, fall outside the journal's scope, duplicate existing discussions without meaningful additional contribution, or violate its publication ethics standards.
5. Right of Reply
When a substantive critique of a published article is considered for publication, the original author(s) will ordinarily be given an opportunity to respond to the issues raised.
Authors' responses should address the substantive arguments presented in the critique and provide relevant explanations, evidence, references, or further analysis where appropriate. Responses are subject to editorial assessment and, when necessary, independent peer review.
Where feasible, the journal may publish the critique and the corresponding author response together or in a coordinated publication sequence. Both contributions will be linked to the original article wherever technically possible.
If the original author(s) decline to respond or fail to respond within the reasonable period specified by the editorial office, the journal may proceed with its editorial assessment based on the available information.
6. Publication and Accessibility
Accepted post-publication discussions may be published as letters to the editor, scholarly comments, critiques, commentaries, or author responses, as appropriate.
Published contributions should clearly identify the article being discussed and provide sufficient bibliographical information to facilitate retrieval and citation. Where technically supported, the journal will establish links between the discussion, the original article, and any subsequent response.
Post-publication discussion does not automatically amend or invalidate the original article. Any necessary changes to a published article will be handled separately in accordance with the journal's Correction and Retraction Policy.
7. Research Integrity Concerns
If a post-publication discussion raises credible concerns about the accuracy, reliability, or ethical integrity of a published article, the editorial team will assess the matter in accordance with the journal's publication ethics policies and relevant COPE guidance.
Depending on the findings of the assessment, appropriate action may include:
-
Publication of a correction when an error requires amendment but does not invalidate the principal findings or arguments.
-
Publication of an Expression of Concern when significant issues remain unresolved pending further investigation.
-
Retraction of the article when serious errors or ethical violations undermine the reliability or integrity of the published scholarly record.
Differences in legal interpretation, theoretical perspective, or scholarly opinion do not, by themselves, constitute research misconduct or grounds for retraction.
8. Confidentiality and Editorial Independence
MAQASIDI: Jurnal Syariah dan Hukum will handle post-publication discussions fairly, transparently, and independently. Relevant correspondence and supporting documentation will be treated confidentially where appropriate, subject to the requirements of a fair investigation and the protection of research integrity.
Editors with actual or potential conflicts of interest will not participate in decisions where their impartiality may reasonably be compromised. Editorial decisions will be guided by scholarly merit, evidence, fairness, and the journal's publication ethics standards.
9. Policy Review
The journal will periodically review this policy to ensure that its procedures remain consistent with developments in scholarly communication, publication ethics, and internationally recognized editorial standards.
Through this policy, MAQASIDI: Jurnal Syariah dan Hukum seeks to foster an open and responsible scholarly environment in which published research can be critically examined, clarified, and developed while preserving the integrity of the academic record.
